Terms of Use

1. Scope and provider

These terms govern your use of the websites ponyagcy.com and ponyagcy.de (the “Website”), operated by Pony Agency, owner Eray Yilmaz, Wuhlestraße 7a, 12683 Berlin, Germany (“we”, “us”). Full provider details are set out in our Imprint.

2. What this Website is

The Website presents our management and marketing services for content creators and lets you send us a non-binding application. No management contract is concluded through this Website. A contract only comes into existence through a separate individual agreement in text form between you and us.

3. Who may use this Website — 18 years and older

The Website and our services are directed exclusively at persons who are at least 18 years old and have full legal capacity. If you are under 18, you may not use the Website and may not submit an application. Before any cooperation begins we verify age against an official photo ID. Any cooperation with a person who turns out to be a minor is terminated immediately.

4. Your application

Applying is free of charge and non-binding for both sides. There is no entitlement to acceptance; we select at our own discretion and are not obliged to give reasons. Please provide truthful and complete information. How we handle the data you submit is described in our Privacy Policy.

5. No guarantee of earnings

Figures, examples, growth rates and creator quotes shown on this Website are individual results achieved in the past. They are not a promise, a forecast or a guarantee of future income. Your results depend on factors outside our control — your content, your niche, the time and effort you invest, the rules and algorithms of the platforms you use, and general market conditions. Working as a self-employed creator carries an entrepreneurial risk, including the risk of earning nothing at all.

6. Your own responsibilities as a creator

If we work together, the following remain your responsibility: registering and filing for tax and social security purposes; complying with the terms of the platforms you use (for example OnlyFans, Fansly, MYM); holding all rights to the content you supply; obtaining and documenting the consent of every identifiable person appearing in your content; and complying with the youth-protection and content rules that apply to you. We advise and support you, but we do not replace tax or legal advice.

7. Use of artificial intelligence

We use AI-assisted tools to prepare drafts for customer and fan communication and for marketing copy. In communication with you, every message is reviewed by a human before it is sent. You may ask to communicate with a human at any time at info@ponyagcy.com. This notice is provided in accordance with Art. 50 of Regulation (EU) 2024/1689 (EU AI Act).

8. Intellectual property

All content on this Website — texts, images, logos, layout and source code — is protected by copyright and belongs to us or our licensors. You may view and print pages for your own non-commercial use. Any other use, in particular reproduction, distribution, adaptation or making available to the public, requires our prior written consent.

9. External links and third-party platforms

This Website links to third-party services (for example Instagram, Telegram and creator platforms). We have no influence on their content and accept no responsibility for it. When you use those services, the operator’s own terms and privacy notices apply.

10. Availability

We work to keep the Website available but do not owe any particular level of uptime. Maintenance, technical faults or force majeure may cause interruptions.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In cases of slight negligence we are liable only where an essential contractual obligation has been breached — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely — and in that case only for the foreseeable damage typical of this type of contract. Any further liability is excluded. This also applies to our legal representatives and vicarious agents.

12. Changes to these terms

We may amend these terms with effect for the future, for example when the law or our services change. The version published on this page, with its version date, applies.

13. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence. Statutory places of jurisdiction remain unaffected.

14. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. The European Commission’s online dispute resolution platform ceased operating on 20 July 2025 and is therefore no longer referenced.

15. Severability

Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
